Privacy Policy

Article 1 (General)

1. Tokuneko Co., Ltd. (hereinafter referred to as the "Company"), which operates the web service “myfans” (hereinafter referred to as the "Service"), respects the privacy of the users of the Service (hereinafter referred to as "Users") and the performers appearing in the content posted by Users on the Service (hereinafter referred to as "Performers"; collectively with Users, referred to as "Users, etc."). The Company shall exercise due care in handling and managing personal information of Users, etc. as well as other information related to their privacy (hereinafter referred to as "Privacy Information").

2. The Company shall handle personal information collected from Users, etc. in an appropriate manner and in compliance with the Act on the Protection of Personal Information and other applicable laws and regulations. In addition, the Company will endeavor to continuously improve its measures for the protection of Privacy Information, including by enhancing its internal management systems and implementing appropriate security technologies, such as SSL.

Article 2 (Consent to this Policy; Withdrawal of Consent)

1. When Users, etc. provide their Privacy Information to the Company through inquiries or membership registration, they shall read this Policy carefully and are deemed to have consented to the contents hereof.

2. Users, etc. may withdraw their consent to the Company’s use and other handling of Privacy Information. In such case, Users, etc. may no longer be able to continue using all or part of the Service.

3. Consent to this Policy and withdrawal of consent pursuant to this Article shall be made in accordance with the procedures prescribed by the Company.

4. The Company will collect information regarding the behavior and preferences of Users, etc. through the use of web tracking technologies, including cookies, IP addresses, and access logs. By using the Service, Users, etc. are deemed to have consented to the Company’s collection and use of Privacy Information through such technologies.

Article 3 (Collected Privacy Information)

2. The Company shall acquire Privacy Information by lawful and fair means and shall not acquire it illicitly against the will of Users, etc.

Article 4 (Purpose of Use of Privacy Information)

The Company will use Privacy Information collected from Users, etc. for the purpose of operating the Service. The main purposes of use are as follows: (1)For billing, identity verification, and authentication; (2)For identity verification; (3)For the settlement of User-posted content; (4)For the transfer of sales proceeds; (5)To send important notifications such as changes to the Terms of Use or policies; (6)To help improve the content and quality of the Service's content and services; (7)To conduct questionnaires, sweepstakes, campaigns, etc.; (8)For marketing research, statistics, and analysis; (9)For system maintenance and handling malfunctions; (10)For the distribution of advertisements and confirmation of their results; (11)To provide technical support and respond to inquiries from customers; (12)To develop and provide targeted advertisements for products or services of the Company or third parties; (13)To prevent fraudulent acts or acts that may be illegal; (14)To handle claims, disputes, lawsuits, etc.; and (15)To perform mosaic processing on the physical appearance of Users, etc.

Article 5 (Provision of Privacy Information to Third Parties)

1. When disclosing or providing personal information of Users, etc. to a third party, the Company shall disclose the recipient and the content of the information to be provided and obtain the consent from the relevant User, etc. Notwithstanding the foregoing, the Company may disclose or provide personal information to a third party without obtaining such consent in any of the following cases: (1)Where disclosure is required pursuant to applicable laws or regulations; (2)Where disclosure is requested by an attorney, public prosecutor, police authority, or other competent authority to the extent necessary for investigations or legal proceedings; (3)Where information is shared among the Company’s affiliates; (4)Where the Company entrusts all or part of its business to a third party, to the extent necessary for the provision and operation of the Service; or (5)Where it is necessary to provide information to payment processing companies or financial institutions to the extent required for the provision of the Service.

2. Where the Company entrusts the handling of personal information to a third party, the Company shall exercise necessary and appropriate supervision over such third party in accordance with the Act on the Protection of Personal Information.

3. In the event that the Company transfers its business to a third party due to a merger, split, or other corporate reorganization, or transfers a part or all of the Service to a third party, the Company shall provide the personal information, etc. of Users, etc. related to the Service to said third party.

Article 6 (Management and Storage Period of Privacy Information)

1. During the period in which Users, etc. use the Service, the Company shall take necessary and appropriate security control measures in accordance with the technological standards at the time to prevent leakage, falsification, etc. of Privacy Information disclosed or provided by said Users, etc.

2. Where the Privacy Information retained by the Company is no longer necessary for the purposes of use, the Company shall endeavor to delete such Privacy Information without undue delay. The same shall apply where deletion of Privacy Information is requested by Users, etc.

Article 7 (Response to Inquiries, etc. by Users, etc.)

1. Users, etc. may request the Company to disclose, correct, add, delete, or suspend the use of their own Privacy Information held by the Company.

2. Users, etc. shall make the request for disclosure, etc. set forth in the preceding paragraph by means prescribed by the Company. Note that such request may be made only by the User, etc. themselves, a statutory agent (if the User, etc. is a minor or an adult ward), or an agent delegated by the User, etc. themselves regarding said request.

3. Upon receipt of a request for disclosure, etc., the Company shall respond within a reasonable period after verifying the identity of the person by means prescribed by the Company. If the Company decides not to disclose, etc. based on laws and regulations, it shall notify the User, etc. to that effect.

4. Users, etc. shall pay the fees set forth below when requesting the disclosure, etc. of Privacy Information. Fee for requests for disclosure, inquiry, addition, correction, and deletion: 500 JPY + Shipping Fee ※In principle, documents will be sent via simplified registered mail (Shipping Fee: 392 JPY).

Article 8 (Use of Analysis Tools, etc.)

1. The Company uses access analysis tools to collect information regarding the behavioral history, etc. of Users, etc. In addition, some of the advertisements, etc. posted on the websites related to the provision of the Service are displayed using services operated by third parties utilizing cookies. 2. Users, etc. may refuse the collection of Privacy Information by the Company or disable behavioral targeting advertising by means such as: 1) disabling cookies from their own browser settings, etc., or 2) opting out from the web pages related to the respective analysis tools or behavioral targeting advertising systems.

3. The change of settings, etc. in the preceding paragraph shall be made at the own responsibility of the Users, etc., and the Company shall not be liable for any damages incurred by Users, etc., such as the inability to view some information due to the change of settings, etc.

Article 9 (Changes to this Policy)

1. The Company may revise this Policy at its own discretion. When revising this Policy, the Company shall notify Users, etc. to that effect in advance by means deemed appropriate by the Company, except in cases of urgency.

2. The revision of this Policy shall take effect at the time the revised Privacy Policy is posted on the website related to the Service.

3. If Users, etc. cannot agree to the revision of this Policy, they may request the Company to delete their own Privacy Information by the means prescribed in Article 7.

Article 10 (Jurisdiction and Governing Law)

1. This Policy shall be interpreted in accordance with the laws of Japan.

2. Users, etc. agree in advance that the Tokyo District Court shall have exclusive jurisdiction for the first instance over any disputes, etc. arising in connection with this Policy.
